1. General

BSH Home Appliances Corporation and its affiliates (“BSH,” “we,” “us”) would like to thank you for visiting our websites and showing interest in our company and our products. This privacy policy applies to www.bosch-home.com/us, www.thermador.com/us/, www.gaggenau.com/us/, and https://www.home-connect.com/us/en/home (collectively the “Websites”). Please note that not all features provided in this privacy policy are applicable to all of these websites.
2. Protection of Personal Data / Protection of privacy

Protecting the security and privacy of Personal Data about you is important to us. Therefore, we conduct our business in compliance with applicable laws regarding protection of personal data and privacy. This Privacy Policy is intended to describe our practices regarding information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual (collectively “Personal Data.”). Please see below for details on what type of Personal Data is collected by BSH, how BSH uses Personal Data, and with whom we share Personal Data.

Please note that for California residents who apply to BSH job positions via our website, you will be presented with a separate CPRA Privacy Policy specifically for job applicants through our online portal in which you can apply for a BSH job position.
3. The categories of Personal Data that BSH has collected about you:

a. Identifiers such as name, postal address, phone number, email address, and other similar identifies.
b. Commercial information from orders, such as invoices for products purchased from BSH, invoices for BSH service technician visits, purchase history for products purchased from BSH, or BSH service visit technician history.
c. Internet Activity.
d. Survey information (e.g. customer satisfaction surveys, marketing surveys).
e. Product reviews and product questions and answers (Q&As) on our Websites.
f. Geolocation data (only if you decide to opt-in and enable the location feature on our “Find your dealer” webpage in order to find the nearest dealer to you).
4. The categories of sources from which Personal Data is collected.

a. Personal Data You Provide to Us

On our Websites, we will not collect any Personal Data about you unless you voluntarily choose to provide that information to us. You can use all the areas of our Websites that are not access-protected without disclosing your identity. When you contact us, submit orders for products, submit orders for BSH service technician visits, submit product registrations, submit online user account registration (not Home Connect), register for newsletter or other marketing communications, participate in sweepstakes, contests, surveys, visit our showrooms, submit for rebate programs, request product brochures, participate in one of our pre-purchase package offerings (e.g. our kitchen planning tool), provide product reviews and product questions and answers (Q&As) on our Websites, or apply for job opportunities with us, we collect one or more categories of Personal Information described above.

a) Automatically Collected Data

Software used on the Websites collects Internet or other electronic network activity information that may, alone or in combination with other information, constitute Personal Data:

a. Log Data

Whenever you visit our Websites, your Internet browser automatically transmits information to our web server (so-called protocol data) for technical reasons. We store some of this information in log files, such as:
  • Date of access

  • URL of the referring website

  • Browser type and version

  • IP address (anonymized)

As a general rule, we only analyze log data in order to eliminate malfunctions in the operation of our Websites or to clarify security incidents. We store this log data without time limitation. Also, in order to rectify faults or to preserve evidence in the event of security incidents, it may sometimes be necessary for us to collect additional Personal Data together with the log data in order to remedy faults or preserve evidence relating to security incidents. We delete this data once the fault has been remedied or the security incident has been conclusively clarified, or the purpose of processing has ceased to apply for other reasons. In the event of a security incident, we will transmit log data to the investigating authorities on a case-by-case basis, to the extent permitted. We always store log data separately from other data collected that relates to the use of our website.

b. Cookies

We use cookies on our Websites. Cookies are small text files that may be stored on your device when visiting one of our Websites. Cookies may utilize various tracking technologies, such as pixel technology. Cookies provides us with information relating to your use and your interactions with our Websites that may be helpful for us in order to improve our Websites, analyze Website usage, and enhance your browsing experience on our Websites. Also, certain cookies, which we refer to as Marketing cookies, allow us to deliver digital advertisements that may be of interest to you.

i. Essential Cookies

We use Essential Cookies to provide basic website operations. They are primarily used to enable our website to respond to your requests (e.g., navigating between different pages on the website, enabling a user shopping cart or user account management), facilitate website security, and other basic website functions. These cookies are required for the basic functioning of the website and will always remain active. It is generally possible to use our Websites without non-Essential cookies. Google cookies for Google Fonts, Maps, and reCAPTCHA features are examples of Essential cookies on our Websites:

a) Google Fonts, Maps, reCAPTCHA:

This site uses so-called web fonts of the provider Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA for the uniform display of fonts. When you access a page, your browser loads the required web fonts into your browser cache to display texts and fonts correctly. For this purpose, the browser you are using has to connect to the servers of Google. This informs Google that our Websites was accessed via your IP address. Your computer will use a standard font if your browser does not support web fonts.

One feature available to you as a user of our Websites is a map showing BSH locations worldwide. We use Google Maps to display this map. Google Maps is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. For the use of the functions of Google Maps it is necessary to store your IP address.

We also use Google Maps to enable the location feature on our “Find your dealer” webpage in order to locate your nearest dealer. In order to enable this location feature, you must decide to opt-in by clicking “Allow” when prompted on our “Find your dealer” webpage. Alternatively, you can decide to locate your nearest dealer on our “Find your dealer” webpage by manually entering your address.

In certain cases, we use the reCAPTCHA service of the company Google LLC to ensure appropriate data security for the use of contact forms. This enables us to differentiate between inputs madeby a natural person and those madefraudulently by machine or automated processing. The service includes the sending of the IP address and if necessary other data required by Google for the reCAPTCHA service to Google.

For these services the information is usually transmitted to a server of Google LLC in the USA and saved there. You can find details on how Personal Data is processed by Google via the following link: https://policies.google.com/privacy.

ii. Marketing Cookies

Marketing cookies are used to identify your preferences across different websites to permit us and our advertising partners to deliver ads more tailored to you and your interests. They are usually placed by advertising networks with the website operator’s permission. They remember that you have visited a website in order to understand your interests and this information is shared with other organizations such as advertisers to deliver relevant ads on other websites.

We may use Marketing cookies to run (and improve) our digital marketing campaigns on our Websites, as well as to track the conversation rate of a particular digital marketing campaign. Our Websites may utilize marketing cookies, such as pixels from various providers such as Google, Meta (formerly known as Facebook), and Pinterest, to run and improve our digital marketing campaigns, and track the conversation rate of such digital marketing campaigns. For example, a Pinterest Tag helps us analyze use of our website and to track the effectiveness of our advertising campaigns (conversion rate tracking). We also use the Pinterest Tag to create audiences and show you personalized advertising based on your interest in our products. For this purpose, Pinterest processes data, which the service collects from pixels, cookies and similar technologies on our website.

Also, as set forth in Sections 11-12 below, with respect to these marketing cookies, you can exercise your California “Do Not Sell or Share My Personal Information” opt-out right by visiting the “Do Not Sell/Share My Personal Information” link at the bottom of this banner. iii. Performance and Other Cookies

We may use Performance cookies to collect information about visitors’ usage on Website and are used to help us enhance your browsing experience on our Website, improve our Websites in general, analyzing Website usage, and measure statistical reach.

We may use Other cookies to provide other functionalities on our Websites, such as, for example, chat functions to ask questions with one of our BSH customer service representatives. For more information on such cookies and tools, please see below.

a) Adobe Analytics and Adobe Experience Platform Launch

In order to carry out marketing and market research and tailor our Websites (and potentially newsletters) appropriately, we use Adobe Analytics cookies and/or JavaScript to collect and process usage data relating to your visit to our Websites and your use of links in the newsletter (if applicable). Your usage data is collected and a usage profile is generated from this data using a cookie ID. The Adobe Experience Platform Launch cookie is a platform tool needed to launch the Adobe Analytics cookie on our Websites. Another words, without the Adobe Experience Platform Launch cookie, it is not technically feasible to launch the Adobe Analytics cookie.

We use the Adobe Analytics service provided by Adobe Systems Software Ireland Ltd., 4-6 Riverwalk, Citywest Business Park, Dublin 24, Ireland (“Adobe”) to collect the usage data and generate the usage profiles. The information relating to your use of our Websites is transferred to Adobe servers, analyzed and solely returned to us as aggregated data. This data allows us to identify trends in how the Websites is generally used.We do not combine the resultant usage profiles with your name or any other Personal Data, such as your e-mail address.Opt-out: Please use Adobe’s opt-out website if you wish to prevent your usage data being collected. b) Adjust

Our Websites and Home Connect app uses the tracking technology “Adjust”, a service provided by Adjust GmbH, Saarbrücker Str. 37A, 10405 Berlin, Germany ("Adjust"). For more information about their product and privacy policy, please visit: https://www.adjust.com/privacy-policy/. When you follow the links provided via our Websites and then launch the Home Connect app after downloading it from the respective app-store, Adjust processes install and event data such as the website you started the download from. This helps us understand how our users are interacting with those links and to optimize and analyze our app attribution model. For such analysis, Adjust uses your mobile identifier like IDFA or Google Play Services ID, and your pseudonymized (hashed) IP- and possibly MAC address. Adjust also tracks your usage frequency of the Home Connect app. If you do not want to be tracked by Adjust, you can choose at the start of the Home Connect app if you allow tracking or not. If you choose not to be tracked, even if the link on the Websites is used, you will not be tracked.

c) Mouseflow

In order to help us design our Websites appropriately, we may collect usage data relating to your visit to our Websites using analytics cookies and other technologies. As part of this, we record the mouse movements and clicks of randomly selected users of our website. Your IP address is anonymized as a matter of course. The resultant log of your use of our Websites is randomly analyzed so that we can derive potential improvements for our Websites from it.

We use service provider Mouseflow ApS, Flaesketorvet 68, 1711 Copenhagen, Denmark for the purpose of collecting this usage data.

We do not combine the resultant usage profiles with Personal Data about you, such as your e-mail address.

d) Optimizely

In order to optimize the user experience, so-called A/B and multivariate tests are carried out from time to time on this website. This means that the person using our website is presented with a different version of the website from the original (e.g. with changed design and content). Comparing the test versions lets us know which version of our website is preferred by users. When Optimizely is used, the only information relating to you that is processed relates to browser details not identifying you. We do not conflate the usage profiles resulting from this with your name or any other details that could disclose your identity, such as your e-mail address.

This service is provided by Optimizely Inc. (631 Howard Street, Suite 100, San Francisco, CA 94105, United States) on our behalf. Cookies are used for this purpose, which are sent and stored on an Optimizely server.

e) Medallia Experience Orchestration Services

This website uses the software-as-a-service experience platform and related online services "Medallia Experience Orchestration" (the "Service") provided by Medallia, Inc., 6220 Stoneridge Mall Rd, Floor 2, Pleasanton, CA 9458, USA.

We use this service to understand how our Website visitors interact with our Websites, on our product registration websites such as registerbosch.com and registerthermador.com and on our appliance package website such as one-two-free.com. Medallia provides us with statistical analysis in an anonymized, aggregated manner for this purpose. We also use this service as a marketing tool to display personalized information to you on our Websites and through email campaigns. Medallia processes this data on our behalf within the framework of a data protection agreement, in which we have agreed that our customers' data may only be processed on our instructions, may not be passed on to third parties and must be sufficiently technically protected. f) Zendesk

While you are visiting our Websites, we may give you the opportunity to learn more about our products and services via a chat with one of our BSH customer service representatives using a Zendesk chat feature. Your interaction with us via this Zendesk chat feature may be collected, recorded, and stored for customer service and quality control purposes. Prior to proceeding with this Zendesk chat feature, we will ask for and obtain your consent.

b) Social Media Plugins

The Websites use social plugins (“plugins”) from social networks like Meta (formerly known as Facebook), Google+ and Twitter. The plugins are identified with the respective social media logo or the respective suffix.

If you visit a page on our Websites that contains such plugins, they are initially disabled. The plugins are not enabled until you click the button that is provided. By enabling the plugins, you establish the connection to the respective social network and declare your consent to the transmission of data to it. If you are logged into the social network, it can associate the visit with your social network account. If you press the respective button, the corresponding information is transmitted directly to the social network by your browser and stored there.

If you do not want a social network to collect data about you via our website, you have to log out of the social network before visiting our site.

c. YouTube

This site uses the video platform YouTube, which is provided by YouTube, LLC, 901 Cherry Ave. San Bruno, CA 94066, USA (“YouTube”). YouTube is a platform which allows the playback of audio and video files.

If you access a corresponding page of our site, the embedded YouTube player will establish a connection to YouTube so that the video or audio file can be transmitted and played. In the process, Personal Data may be transmitted to YouTube. We are not responsible for the processing of Personal Data by YouTube.

Further information concerning the extent and purpose of the collected Personal Data, on the further processing and utilization of Personal Data by YouTube, on your rights and on your data protection options can be found in the privacy policy of YouTube.

d. Instagram

c) Social Media Platforms

On the social media account provided by us via the social media platform, the social media platform grants us access to the following data categories:

  • The social media platform grants us the ability to generate statistical analyses that provide information about the use of our social media account, such as how many times our social media account was viewed, or how many comments were posted in response to our postings on our social media account. The analyses visible to us do not allow us to individually view the usage behavior of individuals. We can only view aggregated data (such as number of likes, followers, etc.) that tells us about our audience and the use of our social media account. The data of the respective user on which the analyses are based are not transmitted to us.
  • We can set a target audience to be reached for posts we make on our social media account. The setting is based on general parameters set by the social media platform (e.g. interests) that can be used to align our content with a specific audience. This target audience function does not allow us to address or identify individual persons. If you contact us directly via the social media platform or interact with us in any other way and consciously transmit Personal Data to us, we store and process this Personal Data for the purposes for which you transmitted it to us (e.g. requests for assistance, etc.
  • We use this data exclusively for the purpose of making content on our social media account known to the target audience and to better understand and optimize the use of our social media account.

In addition, we cannot influence the data processing (for the provision of this data upstream) by the social media provider. Each social media platform operates according to its own Terms of Use and Privacy Policy.
5. Why Do We Process Personal Data?

When you provide BSH with Personal Data, it is used for the following specific business purposes:

  • To respond to inquiries which have been sent to us (e.g. product information, Traders’ certificate);
  • To manage and fulfill orders (including repair service visit orders), which have entered our portal;
  • Marketing communications and promotions;
  • To evaluate customer satisfaction;
  • For marketing and product development purposes.
  • To manage and analyze our websites, and improve our visitors’ experience on our Websites;
  • To provide newsletters
  • To provide your product-related reviews, questions & answers (Q&As) and other product-related information on our Websites;
  • To understand and react to your needs as quickly and efficiently as possible, such as processing product or offer inquires; send your ordered products; confirm product registrations; and inform you about special offers.
  • To find the nearest dealer to you (only if you decide to opt-in and enable the location feature on our “Find your dealer” webpage in order to find the nearest dealer to you).
  • To respond to your interest in our products or where to purchase our products.
  • To evaluate your candidacy for the Thermador Design Counsel and the Thermador-IDS Diversity in Design Pipeline scholarship program.
  • Elimination of disruptions and management of security incidents.
  • To protect against, identify and prevent fraud and other unlawful activity, claims and other liabilities; and
  • To comply with applicable legal requirements, industry standards, and our own policies.
6. How We Disclose Personal Data?

a. Information Disclosed to With Our Service Providers

We work together with various service providers to create and run the Websites and provide the respective services. To the extent that we have bound these service providers to process data in line with strict instructions in their capacity as data processors on our behalf, any data processing activities undertaken by such providers shall not require your consent.

The service providers we have commissioned to create and run the Websites:

  • Service providers for hosting services
  • Service providers for programming services
  • Service providers for responding to customer inquiries, such as a chat function.

We transmit your data to other recipients where necessary to fulfil a contract with you or between you and the third party, where we have or the recipient has a legitimate interest in the disclosure of your data, or where you have given your consent to that transmission. These recipients include service providers and other companies within our corporate group. Furthermore, data may be transmitted to other recipients in the event that we are obliged to do so due to legal provisions or enforceable administrative or court orders.

Other recipients of your data are especially such service providers whose offers and services (third-party services) can be used in connection with the Websites or where the Websites enables access to such services.

Please note that some of these categories of Personal Information may qualify as Sensitive Personal Information under CPRA. However, we do not use such data for purposes other than those set forth in section 7027 of the modified proposed California Privacy Rights Act Regulations.
7. Duration of storage of your Personal Information

Your Personal Information will initially remain stored by BSH for as long as is necessary for the respective purpose of processing. If the purpose for processing is achieved or no longer applicable, BSH will continue to store your Personal Information to the extent that BSH is legally obligated to or entitled to store this data.
8. Security Measures

We take reasonable and appropriate technical and organizational measures to protect Personal Data from loss, misuse and unauthorized access, disclosure, alteration and destruction, taking into account the risks involved in the processing and the nature of the Personal Data. Please note that no method of transmitting Personal Data over the internet is completely secure and we therefore cannot guarantee the security of Personal Data during its transmission or its storage on our systems. Further, while we attempt to ensure the integrity and security of Personal Data, we cannot guarantee that our security measures will prevent third-parties such as so-called hackers from illegally obtaining access to Personal Data. We do not warrant or represent that Personal Information about you will be protected against, loss, misuse, or alteration by third parties.
9. Links to other Websites

The Websites may contain links to other websites and incorporate content and services from other providers (e.g. YouTube, Meta, Google, Twitter) who may use cookies and active components. Please note that this privacy policy does not apply to such third-parties. BSH has no influence over how Personal Data about you is processed on these websites or their compliance with data protection laws. Please familiarize yourself with privacy notices they provide.
10. Children’s Privacy

We do not knowingly collect or use any Personal Data from online visitors under the age of sixteen. We do not knowingly allow visitors under the age of sixteen to participate in any promotions or contests made available on our Websites from time to time. If we discover or are notified that we have collected Personal Data from a person under 16, we will delete that information from our systems.
11. International Transfers of Personal Data

BSH may transfer Personal Data about you to its parent company in Germany, and to any worldwide affiliates of BSH. We may also transfer Personal Data to third parties outside your country of origin.

(ii) Right to request deletion of your Personal Information

You may also request that we delete any Personal Information that we have collected from you, provided that we may retain Personal Information as authorized under CPRA, including, but not limited to, retaining Personal Information necessary to provide our Services, detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, debug to identify and repair errors on our Websites, enable solely internal uses that are reasonably aligned with your expectations based on the your relationship with us, comply with a legal obligation or otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which you provided it.

(iii) Right to request correction of inaccurate Personal Information maintained by BSH in accordance with CPRA.

(v) BSH does not sell (as “sell” is traditionally defined) your personal information. That is, we don't provide your name, phone number, address, email address or other personally identifiable information to third parties in exchange for money. 13. Special Notice to Colorado, Virginia, Utah, and Connecticut Residents

This section describes the Personal Information we collect or process about Colorado, Virginia, Utah and Connecticut residents and describes your rights pursuant to the Colorado Privacy Act, Virginia Consumer Data Protection Act, the Utah Consumer Privacy Act, and Connecticut Data Privacy Act.

In the last 12 months, we have not sold Personal Data collected in and through the Websites. Likewise, we also do not process Personal Data for advertising purposes. Consequently, we do not have an opt-out functionality on the Site.
